we are live in san jose where police are looking for a group of men responsible for the city cease third homicide of the year. we'll tell you how the attack went down last night. some say alcohol and the super bowl go hand and hand. one city official said that is not happening here. big changes could be coming to school sports. also how the ride to work is about to get better for many bart commuters. it's all ahead on the county center channel 2 morning new -- ktvu channel 2 morning news. good morning, everybody it's friday, january 25th i'm brian flores in for dave clark. >> good morning, i'm pam cook. steve paulson is here. doesn't sound like steve but you look like steve. >> thank you very much. i appreciate it. we do have a lot of cloud cover. fog out there as well. a few light showers but still mostly cloddy today. that light shower activity mainly toward san jose.

60s for high. here is sal. westbound 24 looks pretty good. no major problems here. alsos morning commute looks good if you are driving nearby on 680. this is a look at 880 north and southbound. that traffic looks good north and southbound. especially if you are driving through downtown oakland. 5:00 let's go back to the desk. we begin in the south bay where police are investigating the third homicide of the year there. it's the second in consecutive days. ktvu reporter janine de la vega is in san jose where investigators don't have much to go on. janine. >> reporter: brian, we're here on the east side in a neighborhood just off of monterey highway. this is a mix of homes, apartment complexes, and a church there you see there on the corner. this is where the attack happened. we spoke with a man who works at that church said knowing this happened he didn't get much sleep last night. they received a 911 call at 8:30 last night there had been a stabbing at south side drive

and hope street. when they arrived officers found a latino male in his late 30s or early 40s suffering from stab wounds. after speaking with witnesses the victim had been approached by 4-5 young men between the ages of 18-20 years old. there was some sort of scuffle between them. the victim was stabbed several times in his upper torso. >> the number of witnesses we have so far on this, have not told us anything that would help us pinpoint whether or not this was gang related. that is something we just don't know yet. >> homicide detectives spent the night looking for evidence in the neighborhood and talking to witnesses. they also plan on following up with the bar and liquor store nearby if they have any information on it. police also mentioned that some people saw a van gray colored van leaving the area. they are not sure if that is connected. there is no identification on

the victim that was found. the coroners office still has not identified him. and at this point police are still searching for suspects and they don't have a motive yet. coming up you will hear from that church worker to see what he saw last night. reporting live from san jose janine de la vega ktvu channel 2 morning news. police have arrested a middle school student who allegedly bullied two peers in morgan hill. it happened after two 13-year- olds reported a bully assaulted them. now a school resource officer told the bully to stay away but he reportedly threatened the two outside of school. police say the boy will have a juvenile court hearing with his parents. the countdown continues to super bowl sunday. san francisco city leaders are considering tough measures to keep 49er fans in line during the big game. ktvu paul chambers joins us live to tell us some of the proposals that are being proposed.

paul. >> good morning, brian. city officials know people will be out and about drinking. they just want establishments and people to act more responsiblely. we have seen the video of vandals going wild after a giants world series victory. in an effort to prevent something like this happening again they will tour these areas hit by vandals and discuss the city's plan. it will be hopefully effective as last week after the niners game on super bowl sunday. they will have 450-500 officers on the streets. that is three times the normal amount on a sunday. also if that weren't enough fire marshals will come along to keep the peace. closing down bars that will be overcrowded or too rowdy. >> inside the bar where people drink too much. a fight starts, somebody gets stabbed. we don't want that to happen. >> reporter: one major part of the city's plan may be coroversial. mayor lee wants bars that serve

suspected pimp. now there are four defendants in the case. prosecutors are consolidating the four cases into one. 22-year-old calvin sneed were shot and killed last june. two of the accounts are her parents -- two of the defendants are her parents. the taliban is claiming responsibility for a botched suicide car bombing in afghanistan that was supposed to target nato troops. the suicide car bomber was trying to hit a convoy of nato supply instead he rammed into two houses killing five civilians and injuring another 25 people. the u.s. military will not lower its physical standards. defense secretary panetta said to make sure the goal is met with the best qualified people regardless of gender. the military will have until

january 16th to fully imemployment the policy. this morning vice president joe biden is taking the white house campaign for gun control on the road. biden is hosting a round table discussion in richmond, virginia with experts who worked on gun safety. coming up the other efforts under way to pressure congress to vote for gun control. a new service on bart could improve wi-fi and safety. passengers would get free reliable wi-fi service thanks to bart board of directors. the contract is to buy devices that stream livid yes to control centers. bart's current wi-fi access has been the subject of complaints. it could be friday light today. who knows. >> hopefully. >> sal has the answer to that. he's checking on the east shear. >> we are looking at the east shore freeway. the traffic does look pretty good. we hope it will stay friday light. this is a little too early to tell. so far it's doing very nicely

if you are driving in from vallejo to berkeley. also the bay bridge toll plaza it is light there. no major construction delays. we've been watching the construction for you. so far it hasn't caused any major delays. even on the dumbarton bridge. livermore valley the traffic time here is nice. between grantline road and 680. not completely clear but still doing very well. let's go to steve. thank you. very good morning. mostly cloudy. a few light showers. the fog is being reported from north bay down to san jose. visibility is well it's awful for some. very mild on the temps. upper 40s low to mid 50s. 54 half-moon bay and toward the mountain view. a lot of shower activity light. nothing too heavy but it's there. it will be with us in the morning. it stretches from about fremont livermore. light rain there back over toward the santa cruz

hosni mubarak. crowds are expected to grow later today. louisiana governor bobby jindal had harsh words for his physical low republicans. >> we have to stop the -- it's time to start talking like adults. >> november go jindal went on -- governor jindal went on to say it's no secret a number of republicans have damaged our brand with bizarre and offensive comments. he urged republicans to rethink their arguments against democrats. there is a new push this morning from white house to ban assault weapons. as kyla campbell reports vice president joe biden is taking the obama administration push for gun control on the road. >> in a few hours the vice president and other administration officials will be in richmond, virginia. they are holding a round table discussion on the white house's

policy to reduce gun violence. president obama and joe biden are going around capitol hill to crisscross the country in the coming weeks. they wants to win support from people in pro gun states. the president's campaign committee turned gun safety committee is raising money now. the group is called organizing for action. it has millions of volunteers nation-wide. meanwhile democrats are trying to gain support on capitol hill after california senator dianne feinstein reintroduced a bill to ban assault weapons and high capacity magazines. >> once you have been through one of these episodes, once you see what the crime scene is like, it isn't like the movies. it changes your view of weapons. >> reporter: many republicans don't think an assault weapons ban is the right way to reduce gun violence. what they have to say when i see you next. live in washington kyla campbell. >> there could be sweeping changes in school sports programs following an order

that would be issued today. the u.s. education department will tell schools they must give students with disabilities a fair shot to play on a traditional school sports team. they will be required to make what the directive calls reasonable modification for students with disabilities or create new leagues. so far there is no deadline on when the schools must comply. a new strain of norovirus is spending here in the united states. the center for disease control says the so-called sydney norovirus strain from australia has caused outbreaks here. symptoms include vomiting, other flu like symptoms. washing your hands can help. it looks like senior officials have tonged a big bullet. the district attorney has announced charges won't be tiled after allegations they hid millions of dollars in state funds. the funding scandal came as the state threatened to close 70

parks because of budget cuts. but the da office said it would be hard to prove any criminal wrong doing. time is 5:15. football fans are talking about two brothers both head coaches facing each other in the super bowl. now the harbaugh family is giving the media even more to talk about following a conference call. that story coming up at 5:25. a bay area billion area may try to keep the seattle group from buying the sacramento kings. oracle ceo larry ellison is expected to meet with sacramento mayor kevin johnson about the team according to the sacramento bee. we know ellison is interested in nba ownership. he tried to buy the warriors a few years ago. 5:15 is the time right now. sal is checking in on the toll plaza. >> it is early. hopefully we will have a nice day at the toll plaza. this is one of our main commutes. so far so good. not a big delay at the toll

plaza right now. also the morning commute looks good for you if you are northbound 101. that traffic is moving along nicely as you get there there. if you are driving on the hayward to union city to fremont commute that is nice. but for the most part it starts getting busier after 6:00. across the bay 880 southbound looks good from 380 to 92. about eight minutes which is the standard right. and northbound 101 about 20 minutes. gets a little bit worse than that later. right now it's not a bad drive at all. 5:16 let's go to steve. thank you sal. very good morning. very strong low is really giving southern california a lot of rain. but it's still sending in a couple bands to us. the system to the north will push most of the moisture out of the area. still you will see a little line of showers.

some of that is to the north bay and east bay as well. be careful that visibility can be awful and usually gets worse as we go into the 7:00, 8:00 hour. upper 40s to low to mid 50s. very mild compared to where we were a week ago. you can see the shower activity back in the santa cruz mountains. that low moving out of the picture will take a lot of its moisture with it. today we will still be mostly cloudy. a few sun break. one low moves out and a colder one moves in. cloud, sun, mild patchy fog. light rain to the south. low 60s on the temps. and coast bay inland. i think everybody is within a couple degrees. your weekend always in view there a colder system drops in sunday. and the next week looking dry but cool and breezy. this morning samsung

announced fourth quarter profits of $6.6 billion. that is an increase of 76%. samsung says the popularity helped boost profits. galaxies outsold iphones for the fourth quarter in a row. it is the worst performing of all the asian markets so far this year. in contrast japan nikkei finished the year a three year high. checking in on the european markets all of them most of them are upright now. and our markets futures indicate a higher opening here in the u.s. as well. that follows decent gain for the dow jones up 46 points. s & p did cross 1500 yesterday. it might test that level today. coming up. for the rebuilding process for hurricane sandy just starting in new jersey.

welcome back to the ktvu channel 2 morning news. look at that huge flames from a building fire in massachusetts. but it was the freezing conditions that proved more challenging to firefighters. spray from the fire hoses formed ice and made for slippery conditions. look at that firefighters helmet. icicles were forming on helmets and jackets while they were fighting that fire. the people of new jersey who lost their homes to hurricane sandy will have to meet new standards when rebuilding. governor chris christie says the new guidelines comes from the emergency management agency. they are based on new flood maps that indicate the new jersey shore is a higher risk zone that previously thought. the new standard includes how high new homes will have to be. >> doing these new standards will make your building safer. no question it will increase

the cost of rebuilding. that is the downside to it. >> the new standards will go into effect as soon as the state files the necessary paper work. the national media has dubbed this year super bowl that. the har-bowl. both head coaches facing each other in football's biggest game. yesterday the harbaugh family gave the media even more to talk about. it happened when the parents took part in a conference call. listen closely. >> our next question comes from john from baltimore. >> yeah question from baltimore. is it true that both of you like jim better than john? >> you nuts. john how are you? >> is that john harbaugh? here if you are driving on to the south bay freeways. we're going to probably go through this freeway. nice and light on northbound 280 at 880. it's a nice looking drive. if you're trying to get to the south bay from the east bay, i think the traffic time will be to your liking. between highway 238 and mallory avenue. just about under 15 minutes. the other day we had it almost an hour when we had a crash. now at 5:25 let's go to steve. sal, thank you. we have a little bit of rain and a lot of fog out there. most of that rain looks like it's winding down. mostly cloudy here today. highs today with few showers. in the morning we will give way to partly cloudy to mostly cloudy skies. low 60s for highs. coming up next a contra costa county high school student rushed to the hospital after a fight in the cafeteria. why the principal believes social media may be to blame. antioch elementary school student did the right thing. the warning going out to students and parents today.

showers. overall very mild. we're in the 40s and 50s. partly cloudy. 60s with temps. here is sal. good morning. traffic is moving along pretty well if you are driving on westbound 237. a little bit wet in the south bay. it hasn't been wet in the north bay. also the morning commute looks good as you drive out to the high-rise. now back to the desk. thank you, sal. topping our news this morning new fears in antioch after a man tried to lure a young boy in his car. noelle. >> the warning was sent out yesterday for parents and students here. the principal sent it out yesterday afternoon after a report of an attempted abduction. it happened yesterday afternoon a parent called a school to report a has been tried to lure her fifth grade son into his car. the suspect was last seen

attache chough park which is a parking lot right behind the school. the suspect told the boy he was sent by a family member to pick him up. the boy said i don't know you and walked away. the attempted abduction took fear into any man. we just talked to a man that just moved to the neighborhood. >> it's kind of shocking. i just moved out here. i'm not used to having to worry about that. >> reporter: so here's the suspect description. caucasian male gray hair has facial stubble and driving a light blue '70s era car. again that boy did the right thing following the stranger danger rules by not getting in the car and walking away. reporting live in antioch noelle walker ktvu channel 2 news. a contra costa county high

school student was air lifted to the hospital after an argument intensified over the internet. the principal at freedom high told the contra costa times that two girls bumped into each other at the hospital wednesday. they later exchanged angry online posts. one of the girls then attacked the other in the school cafeteria yesterday. the victim fell and hit her head. we don't know the extent of her injuries. the principals urged not to air disputes over social media. they are looking far group of young men that are responsible for a deadly stabbing last night. janine de la vega is in san jose where investigators are looking for a motive behind the attack. janine. >> reporter: police are trying to track down this group of young men that stabbed a man here on south side drive which is just off of monterey highway. it's a residential area. there is a church here at the intersection. now at this point, they don't know what prompted this attack. police say a man was

approached. some kind of confrontation occurred and the man got stabbed multiple times in his upper torso. he was rushed to regional medical center where he died. the fatal attack is not sitting well with neighbors who say violence is increasing here. >> this is a really quiet street. it's a nice neighborhood and i know we lost a lot of sleep. >> reporter: you said from time to time you hear gunfire though. >> yeah. we do. >> reporter: police say they do not have a motive yet in this case and don't have anyone in custody. police did see a light colored van leaving the scene. they are unsure if that is connected to the fatal stabbing. at this point, they do not think that this attack is gang related. there is no identification found on the victim. so right now the coroner still does not know who this man is. police tell us he's a latino

man. they believe in his late 30s to early 40s. now this is the second homicide that has happened in just a week's time and the third homicide in the city of san jose so far this year. reporting live from san jose janine de la vega ktvu channel 2 news. >> in over night news the car fire forced the evacuation of an apartment building. the sedan was parked in a carport when it caught fire. investigators won't comment tenants believe it was intentionally set because there were two separate fires. one in the front of the car and the other in the trunk. >> yes, it looks suspicious. we have people with families over here and kind of difficult for us. >> there were no injuries. firefighters kept the flames from spreading to upstairs units. people who work in restaurants in san francisco could get an extra payday.

they are being targeted for charging extra fees. the city claims only about a third of that money actually went to medical costs. today san francisco city attorney plans to announce a program that would require restaurants and a handful of other businesses to pay back a portion of that money to employees. time now 4:34. more digging has begun at a lyndon well where thousands of bone fragments have been linked to a serial killer case. the fbi has decided to concentrate on a new location after getting a letter from wesley shermantime. meanwhile it's been 24 years since ilene was abducted while walking home from school in dublin. next wednesday her family is planning to mark the anniversary with a candle light mark and service. this years event will start at 7:00 p.m. at wells middle school.

the walk will mark the path taken by ilene. isaac mcdaniels received a 35 year prison sentence. he was convicted of being an accessory in the 2011 homicide. he confessed to giving a gun to the accused shooter but most of mcdaniel's prison term comes from an unrelated sexual assault days earlier. there is conflicting information about whether or not the shooting of some high school students in the east bay may have been connected to a pair of shoes. the shoots happened wednesday. the teenagers attend nearby al banny high. police are not confirming that information at this point. one of the students is still in the hospital. a benefit concert for injured san francisco giants fan bryan stow will be held in the north bay.

giants third base coach will perform at the sweet water music hall. stow was injured in an attack at dodger stadium. the 49ers are heading to the super bowl after a quarterback switch. fans everywhere say both quarterbacks have shown a lot of class during the transition. the sharks back on the ice in san jose and fans couldn't be happier. it looks like black friday at macy's fans rushing through the doors. bear hugging sharky the team mascot. that lockout kept the fans away for months. >> i waited months for san jose to come back and you know play a home game. i'm so excited to watch. >> employees of hp pavilion and downtown bars and restaurants are very excited.

their work hours were cut during the lockout. as for the game they beat the coyotes 5-3. >> good to have them back. time is 5:37. let's get you out the door. sal is taking a look traffic. you're look agent the san mateo bridge. >> that is right. we are going to start with the san mateo bridge. looking at that the traffic looks good. the traffic on this bridge usually starts getting a little slow around the 8:00 hour. you have a little bit of time if it goes all true to form. of course when there is a crash all bets are off. looking a the the commute at the toll plaza this commute usually starts getting busy at about 6:15. i'm just telling you the time but everything changes. the weather here in the north bay. north of the san mateo bridge dry on the roads a little bit south of it we have wet roads. and the morning commute on the nimitz freeway. we watch it the commute time

here between 238 animo reless than 15 minutes. let's go to steve. thank you. a very good morning. sal is right some of the wet roads left over. two systems. this one the northern edge of system down in southern california. and then there is a colder one up to the north. and we have fog around. there is a lot of fog around. that will take us about 9:00. some of that fog thickens up. very, very mild pattern over us. low to mid 50s. temperatures i've really rebounded well. there is a lot of moisture and cloud cover. this system to the north will push the remaining moisture south and east. patchy fog. mostly cloudy here in the morning. then we will see a few lingering showers. i think it's about done. there is a lot of moisture in the air. very muggy as well. light rain pushing off south and out of the picture. very mild up in the sierra

good morning. here's a quick look at the top stories we're following right few. the big game is now nine days away and san francisco city leaders are considering tough measures to keep 49er fans in line during the super bowl mayor ed lee is urging san francisco bars to hold off selling hard booze during the big game. police will also be out in full force. parents in antioch are being warned about a man who tried to lure a boy into his car. a man tried to lure a fifth grade boy near second degreer elementary school yesterday afternoon. vice president joe biden is hosting a round table on gun violence. taking part in the round table are experts who worked on gun safety following the 2007 shooting at virginia tech. the sound of cheering for gay couples in rhode island late last night. the rhode island house passed legislation that would allow same sex couples to get married. but it is not official yet. the bill has to go to the

senate. right now rhode island is the only state in new england that does not allow same sex couples to get married. optimistic state of the state speech governor jerry brown says california is back. thanks to budget cutting by legislatures and the passage of proposition 30 last november by voters, california now has a balanced budget. the governor says now the state needs to live within our means and establish a rainy day fund to get through lean times. the governor also reiterated his support for controversial projects including tunnels to divert water fromthe delta and high speed rail. we'll keep an eye on apple stock after the markets open. they had a rough day yesterday with its stock price falling 12%. apple shares will open at $4450. hundreds of volunteers fanned out across san francisco last night to count the city's homeless population. the census is taken every two years. collected data is then used to

secure millions of people in federal funding to provide services to the homeless. volunteers say the count is a way of giving back. >> i'm a san francisco resident and this is a way for the city to continue to get funding to help the homeless. and i also work at san francisco general hospital. so we help a lot of homeless patients and get medical care and get back on their feet. >> last nights numbers will be added to other counts done by city staff. a final tally is expected in a few weeks. we checked san francisco's last survey in 2011. et showed more than 6400 homeless living on city streets. 10% of those people reported they were part of a homeless family. 20% blame alcohol or drug abuse as a primary cause of their homelessness. no question it has been a truly remarkable season for the san francisco 49ers. the niners are one of the few teams to make it to the super bowl after switching quarterbacks in the middle of

the season. colin kaepernick took alex smith's job. fans agree both quarterback have to show a lot 06 -- they have shown a lot of class during the transition. and smith and kaepernick have high praise for each other as they get ready for the super bowl. >> it means a lot. it really shows his character and the kind of man he is he's helped me through everything. from week one until now. >> it's the nature of sports. he got an opportunity to step up and made the most of it. that's the deal. that's how i got my start in college was no different. a guy got hurt and that's how i got my first start. >> fans also remember it was alex smith who first taught kaepernick the 49er offense during the lockout two seasons ago. kaepernick fever is heating up in his hometown ovator lock. they have named a hot dog and burger after the man. people are waiting in lines up

mark zuckerberg is hosting a fundraiser for the governor energize reelection campaign. he met chris christie when he donated $100 million to public schools in new jersey. christie is a republican and considered a shine to win the reelection. minority groups are trying to block new york city controversial soda ban from taking place in march. limiting the sale of sugary drinks over 16-ounces will help fight obesity. but the naacp along with the hispanic federation argue that small and minority businesses will be effected. the ban should have been put into vote in the city council instead of being approved by the bloom burg appointed health board. it has been in the works for four years. now plans to -- last night the planning commission approved the environmental impact report which would add a grocery section to the store.

the report was revised after opponents challenged it in court in 2010. while some are against the plan others say it will create about 85 new jobs. the battle heats up in court every the closure of oyster farm. the operator of drakes bay oyster farm is suing the national park service for the right to operate in thest too area. jerry hill will introduce legislation to protect mountain lions. it follows public outcry after game wardens shot and killed two mountain lion cubs. under the current law it's illegal to rehabilitate mountain lions. this morning cal tran will give the news media a big up close look at the tower plan.
